The purpose of the Register of Wills is to ensure that:
1) The last wishes of the decedent will be carried out.
2) The heirs, legatees and creditors will receive what they are entitled to.
3) That the proper taxes and fees will be collected in accordance with Maryland Law.
When a person dies with a Last Will and Testament, the Will must be filed with the Register of Wills’ office in the county or city where the decedent had lived.
If the decedent dies owning assets (that do not otherwise automatically pass to the decedent’s beneficiaries or heirs,) Maryland laws provide for an orderly process to transfer those assets. This process sometimes is referred to as “the probate proceedings.”
